The purpose of this memorandum is to provide public education agency personnel with amended language to “Your Rights Under the IDEA,” a document that must be provided to parents of children suspected of having or identified as having a disability within the meaning of the Individuals with Disabilities Education Act (IDEA). Changes to this document are the result of statutory changes that took effect July 1, 2005, consistent with The Individuals with Disabilities Education Improvement Act of 2004.  The attached document contains those changes.  All other provisions of the statement of parental rights remain in full force and effect.

The U.S. Department of Education is in the process of promulgating final federal rules implementing the reauthorized IDEA. It is anticipated that the final regulations will be published in December. Any additional changes to parents’ rights that result from those regulations will also be included in an overall revision of the parents’ rights document, incorporating into a single document all parental rights. Until then, public education agencies are to continue to provide parents with a copy of the existing parents’ rights document and the attached notice of Amendments to “Your Rights Under the IDEA.”
