The Gun-Free Schools Act (GFSA) states that each state receiving federal funds under the Elementary and Secondary Education Act (ESEA) must have a state law requiring all local educational agencies (LEAs) in the state to expel from school for at least one year any student found bringing firearms to school. Under the GFSA, LEAs receiving ESEA funds must adopt a policy requiring referral to the criminal justice or juvenile delinquency system of any student who brings a firearm to school. In addition, the GFSA states that it must be consistent with the Individuals with Disabilities Education Act (IDEA). Attached is a copy of the Gun-Free School Act School District Report Form to be completed and returned by NOVEMBER 16, 2000.
The GFSA also states that nothing in the GFSA shall be construed to prevent a state from allowing a local educational agency that has expelled a student from that student's regular school setting from providing educational services to that student in an alternative setting.
This incident reporting form will be the only form accepted by this office. PLEASE DO NOT ADD OR DELETE CATEGORIES ON THIS FORM. Send the official ORIGINAL COPY to the Arkansas Department of Education, making sure a copy of the records is maintained in the school district's files.
Please use the attached forms to provide information on implementation of the Gun-Free Schools Report. THIS INFORMATION SHOULD BE A COMPOSITE OF THE ENTIRE SCHOOL DISTRICT.
