The purpose of this memorandum is to remind local education agencies (LEA) that Part B funds may be used to implement school-wide programs under Section 1114 of the ESEA. Part B funds may be used as long as students with disabilities, included in Title I programs, receive services in accordance with a properly developed Individualized Education Program (IEP) and are afforded all of the rights and services guaranteed to children with disabilities under the Individuals with Disabilities Education Act Amendments of 1997 (IDEA 97).

LEAs may use Part B funds for any fiscal year to carry out a school-wide program in accordance with 34 CFR Section 300.234 and Section 1114 of ESEA. The amount used in any such program shall not exceed the number of children with disabilities participating in the school-wide program multiplied by the amount received by the LEA under Part B of IDEA for that fiscal year divided by the number of children with disabilities in the jurisdiction of that LEA.
