Act 1138 of 2001, the Classified School Employee Minimum Salary Act (Act), requires districts pay no less than an hourly rate of six dollars and twenty-five cents ($6.25) per hour to all permanent, contracted, classified employees paid from the district's classified salary schedule. Districts are prohibited from reducing the hourly rate of pay for classified workers as a result of this Act.
The Department of Education has received questions requesting clarification of the classified personnel covered by this Act. Specifically, this statute does not apply to substitutes and temporary workers who are not required to have annual, written contracts as provided for in A.C.A. 6-13-620.
