In accordance with ADE Special Education regulation, Section 22.09.1, it is the policy of the State Board of Education that school districts provide a 'genuine opportunity' to students with disabilities who are home schooled to access special education and related services from the district where they reside.
This means that home-school students with disabilities must be given the same genuine opportunity as private school students to access special education and related services. Although no private school/home-school child with a disability has an individual right to special education and related services, as a group, they are entitled to a genuine opportunity to participate.
For that reason, the Special Education Unit is conducting a survey for the purpose of identifying the number of students with disabilities within each LEA who are being home schooled. Please return the completed survey no later than September 24, 2001.
NOTE: The completion of this survey is not optional. It must be completed and returned even if there are no home-school students with disabilities residing in the school district.
