The purpose of Act 1398 of 2003, entitled AN ACT TO PROVIDE TEACHERS WITH ADDITIONAL TIME FOR INSTRUCTIONAL PURPOSES; AND FOR OTHER PURPOSES, subtitled AN ACT TO PROVIDE ADDITIONAL TIME FOR INSTRUCTIONAL PURPOSES, is to provide additional time for instructional purposes and to reduce the amount of time for non-instructional duties. This legislation, enacted by the General Assembly of the State of Arkansas, requires that "any teacher assigned more than sixty (60) minutes of non-instructional duties per week shall be contracted with in accordance with § 6-17-807(g)."
§ 6-17-807(g) requires that "a district which contracts with a teacher to teach summer school or to perform services that do not require the teacher to hold a teaching certificate to perform those services shall enter into a separate contract with the teacher for those services and shall not condition initial employment of the teacher or renewal of the teacher's regular teaching contract on entering into such a separate contract."
Act 1398 of 2003 defines non-instructional duties as "the supervision of students before or after the instructional day begins or ends for students or for the supervision of students during breakfasts, lunches, recesses, or scheduled breaks."
