Section 1120A(c) of No Child Left Behind states that local educational agencies (LEAs) may receive Title I funds only if state and local funds will be used in schools served under Title I Part A to provide services that, taken as a whole, are at least comparable to services in schools that are not receiving funds under Title I Part A. If all the LEA's schools receive Title I services, the LEA may receive Title I funds only if state and local funds are used to provide services, that taken as a whole, are substantially comparable in each school.

Many LEAs that were consolidated/annexed July 1, 2004 will have to file a Title I Comparability Report for the first time. A technical assistance work session will be held on Wednesday, November 10, 2004 from 10:00 a.m. to 12:00 noon at North Little Rock East High School in the Mini-Auditorium. Attendance is not required. If assistance is needed to complete the Title I Comparability Report (copy attached), the district should bring the following information to the workshop:

1. The names and grade spans of the schools in the district.
2. The enrollment of each school.
3. A list of staff members in each school by FTE that identifies the program(s) from which that staff member is paid.
4. A list of schools receiving Title I services in 2004-2005. (This can be the Title I Public page from the ACSIP federal budgets.)
5. A copy of the Title I Comparability Report (attached)

None of the Title I Comparability Report requirements have changed from the 2003-2004 school year.

REMEMBER, ONLY SCHOOL DISTRICTS WITH MORE THAN ONE SCHOOL PER GRADE LEVEL ARE REQUIRED TO COMPLETE THE TITLE I COMPARABILITY REPORT.

If an LEA is found not to be in compliance with the comparability requirement, funds are to either be withheld from the LEA or repaid by the LEA for the time period of non-compliance. Whether funds are withheld or repaid depends on when the violation is determined. Because the purpose of the comparability requirement is to ensure that Title I schools receive the same level of services from State and local funds as other schools. Determinations must be made as early as possible in the school year.

Again, there have been no changes in the Title I Comparability Report, and this workshop is being held to assist districts having difficulty with completion of the Comparability Report. Attendance at the workshop is totally voluntary.

The attached report form is in Excel format. To move between the different pages of the report, use the tabs at the bottom of the page. Copy the report to a district computer. When completed, print the report, have the person responsible for completing the report sign it, and submit to:
