The Individuals with Disabilities Education Improvement Act of 2004 (IDEA) and its implementing federal regulations change some of the provisions of the State Complaint Procedures. State complaint procedures are found at 34 Code of Federal Regulations (CFR) зз 300.151-300.153. These regulations take effect on Friday, October 13, 2006. The attachment contains the State Complaint Procedures with new language underlined and deleted language lined out. The Arkansas Department of Education, Special Education Unit, has begun revising the state Special Education Rules, including the State Complaint Procedures, with a target completion date of June 30, 2007. Proposed revised Rules will be subject to public review and comment prior to adoption.
