Arkansas Department of Education (ADE) Commissioner’s memo Com–07–005, dated July 19, 2006, which outlined the requirements of Act 1963 of 2005 for Shielded Outdoor Lighting is rescinded.
Act 124 of 2007 has added an additional subsection to Ark. Code Ann. § 8-14-104 that establishes an exemption to this law for public school districts and others.
While public school districts are no longer required to adhere to the Shielded Outdoor Lighting law, the districts are encouraged to consider properties and streets that abut the school district properties as to not allow school district outside lighting to create a driving hazard nor infringe on the privacy of private land owners.
