Act 659 of 2007 is an Act concerning energy saving contracts for school districts and amends Ark. Code Ann. Sec. 6-20-405.
The act adds to the energy cost savings guaranteed by the qualified provider: to the extent necessary to pay all of the costs of the energy conservation measures, to include “all costs of financing and annual services that may include measurement and verification of the guaranteed savings.” The act further eliminates the requirement to provide certification that all energy consuming products utilized in the projects will be certified with the appropriate standards by the Air Conditioning and Refrigeration Institute. All other provisions of the law remain essentially unchanged.
