Ark. Code Ann. § 5–64–411 was recently amended by the 86th General Assembly to include school bus stops as locations for which additional penalties may be levied for the sale, delivery, possession with intent to deliver, dispensing, manufacturing, transporting, administering, or distributing a controlled substance. A conviction of any offense listed above within 1000 ft. of a designated school bus stop may subject the offender to an additional ten year term of imprisonment.
School districts are asked to ensure that local law enforcement agencies are provided with the most current list of designated school bus stops. This list should be provided prior to the start of the school year and updated as deemed necessary by the school district.
School districts are also reminded of section (d)(1) of Ark. Code Ann. § 5–64–411 which states that the following notice must be posted at the entrance to all public elementary and secondary schools. The notice to read: “ THE SALE OF DRUGS UPON OR WITHIN ONE THOUSAND FEET (1000 ft) OF THIS PROPERTY MAY SUBJECT THE SELLER OF THE DRUGS TO AN ADDITIONAL TEN (10) YEARS IMPRISONMENT IN ADDITION TO THE TERM OF IMPRISONMENT OTHERWISE PROVIDED FOR THE UNLAWFUL SALE OF DRUGS.”
