Ark. Code Ann. § 6-10-106(d), as amended by Act 1469 of 2009, requires each school district to adopt an academic school calendar that includes five (5) make-up days for days unavoidably lost due to exceptional or emergency circumstances resulting from contagious disease outbreaks, inclement weather, or other acts of God.

Therefore, five (5) extra days should be built into the Arkansas Public School Computer Network (APSCN) calendar as non-membership days using the day type of “XDY” – ACT 1469 Ext Day. APSCN will load this day type into district databases July 1, 2009. Calendar data is a required dataset in Cycle 1; therefore, it should be updated prior to the Cycle 1 submission. This data, in conjunction with the Statement of Assurance signed by the superintendent and submitted to the Standards Assurance Unit during the Cycle 2 submission, will be used to monitor compliance as required under Act 1469 of 2009.
