Act 377 was passed during the regular legislative session of the 87th Arkansas General Assembly of 2009. Act 377 is “an act to ensure students categorized with behavioral disabilities in other states are promptly and adequately placed in the Arkansas public school system.”
The Act applies to a child who enrolls for the first time in special education services at an Arkansas public school and has been previously determined by a school district in another state to be eligible for special education services due to a behavioral disability.
The remainder of the Act specifies the process and procedures to be followed by the enrolling Arkansas public school district upon enrollment of such a student, consistent with the requirements of Arkansas state Special Education Rule and 34 Code of Federal Regulation, Part 300, that addresses requirements applicable to provision of special education services to incoming out-of-state students with disabilities with Individualized Education Programs (IEPs).
