Act 30 of 1999 amended A.C.A. § 24-7-708(f) to allow the State Board of Education to establish Rules and Regulations Governing Waivers of the Earnings Limitations Under the Teacher Retirement System.
At the August 9, 1999, meeting, the State Board gave final approval to those regulations. The regulations will now be reviewed by the Legislature.
The waiver process is provided to assist districts whenever an appropriately licensed active employee is unavailable to fill an essential vacant position. The waivers are granted for one year.
The attached copy of the approved rules and regulations outlines the conditions under which a waiver may be granted. After a determination is made to recommend the waiver, ADE submits the waiver request to Teacher Retirement. The final decision regarding the approval of the waiver rests with the Director of Teacher Retirement, as the Retirement Board's designee.
Please note Section 6.05 which states that no payment under the conditions of the waiver can occur prior to the effective approval date of the waiver of earnings limitation. These regulations will not be effective before September 30.
