The purpose of this memo is to remedy a source of confusion which was created by Director's Memo SI-00-064, January 25, 2000. The error was in Act 1301 pertaining to the School Uniform Initiative Act.
In order to correct an error, Section 6-18-102(b)(2)(A), as amended by Acts 1999, No. 1301, Section 1, is amended to read as follows:
"(B)(2)(A) If the advisory committee recommends to the board that a uniform dress code for students be adopted, if no uniform dress code is adopted by the school board at least thirty (30) days prior to the filing deadline for the annual school election, and if not less than five percent (5%) of the qualified electors in the district SIGN A PETITION TO HAVE the question of a uniform dress code voted upon, the board shall refer the issue of a dress code to the qualified electors of the district during the 2000 annual school election."
If the school board does not adopt a uniform dress code, the only way that the issue can come before the electors is if five percent (5%) of the qualified electors in the district sign a petition to be placed on the 2000 annual election.
