The purpose of this memorandum is to transmit a copy of a memorandum from the U.S. Department of Education, Office of Special Education Programs (OSEP), regarding "Questions and Answers on Obligations of Public Agencies in Serving Children with Disabilities Placed by Their Parents at Private Schools." This memorandum has been prepared by OSEP in response to questions OSEP has received regarding private school placement of students with disabilities by their parents.
The OSEP memorandum addresses the 45 most frequently asked questions regarding private school placement of students with disabilities by their parents. The memorandum goes into great detail regarding the obligations of public agencies for these students. Please contact this office, if you have questions unanswered in the regulations or in the enclosed OSEP memorandum.
