This constitutes official notice of the FINAL 2002 Title I, Part A total allotment. These funds are available for use in the 2001-2002 school year under provisions of the Elementary and Secondary Education Act of 1965, as amended. The U. S. Congress has approved Public Law 107-20 providing a supplemental appropriation. This along with revised rules and regulations resulted in a change in the hold harmless provision as well as a change in the amount of funds available. Under this provision, Arkansas received $1,589,582 in additional funds.
Even though Congress established a hold harmless provision in Public Law 106-554 {the U. S. Department of Education (ED) Appropriations Act for Fiscal Year 2001} the funds in the supplemental appropriation were not enough to provide every LEA with its “greater of the two” hold harmless amount; therefore, ED reduced each school district’s hold harmless amount to the amount made available for allocation. As a result, a number of school districts received less Title I funds than the preliminary 2001-2002 allocation made in early June.
ED has reviewed and validated the original Title I allocation and the final allocation for 2001-2002 school year. After reviewing the allocation procedures, ED assured the Arkansas Department of Education that both allocations followed the letter of the Title I law at the time each allocation was made.
School districts will not receive a new individual Notice of Funds Allotment. All 2001-2002 allocations are listed on the attachment to this Director’s Communication. Please review this listing for changes to the school district Title I allocations. Also review local institution Part D, state agency Part D, and Neglected Institution allotments changes.
Each district’s Title I allocation for 2001-2002 could be reduced if the district has Title I low-income eligibles enrolled in a charter school which is an LEA when the official count is taken on October 1.
PLEASE ADJUST PREVIOUSLY SUBMITTED TITLE I BUDGETS TO REFLECT THE REVISED ALLOCATION AND RESUBMIT TO THE TITLE I PROGRAM OFFICE. SHOULD THE BUDGET REVISION CAUSE PROGRAMMATIC ADJUSTMENTS, IT WILL BE NECESSARY TO SUBMIT THESE ADJUSTMENTS WITH THE BUDGET. THIS RESUBMISSION SHOULD BE HANDLED UNDER PREVIOUS GUIDELINES FOR ELECTRONIC SUBMISSION TO THE FTP SITE. ALL ADJUSTMENTS SHOULD BE SUBMITTED BY SEPTEMBER 24, 2001 SO FUNDS CAN BE TRANSMITTED IN A TIMELY MANNER.
