Clarifying documentation required by the 'Rule Governing Ethical Guidelines and Prohibitions for Educational Administrators, Employees, Board Members, and Other Parties' (Rule)
Act 1599 was enacted in 2001 (see Ark. Code Ann. § 6-24-101) to prohibit self-dealing in transactions between educational entities and board members, administrators, or employees. This law requires that, under certain circumstances, districts are required to obtain approval from the Department prior to executing some contracts. Since enactment almost 1,400 requests for approval have been submitted. The purpose of this memo is to address common errors and omissions districts make in submitting the Contract Disclosure Forms and Resolutions to the Department. Each district should review the Contract Disclosure Form E and Resolution Form F against the attached checklists prior to submission to the Department.
